Judge to Take Up 38 Studios Document Release

PROVIDENCE, R.I. (AP) — The Rhode Island judge in the 38 Studios case is expected to hear arguments related to the public release of depositions and other documents.

The parties in the litigation are expected in court on Friday.

The Senate Oversight Committee and the media requested the materials under open records law, but the defendants have asked the judge to keep them confidential. Attorneys for the defendants say that if the judge does find they are subject to public disclosure, it shouldn't be until all depositions have taken place.

The state's economic development agency in 2010 approved a $75 million loan guarantee for Curt Schilling's startup video game company. It later went bankrupt, and the agency filed suit against the ex-Red Sox pitcher and others.

The agency's attorneys support the materials' release.
