Man in police brutality case charged with assault

NORTH PROVIDENCE, R.I. (AP) — A man suing Providence police for alleged brutality has been charged with misdemeanor assault and resisting arrest in North Providence.

North Providence police arrested 25-year-old Luis Mendonca on Sept. 2. Police reports say Mendonca struggled with three police officers who tried to stop him from fighting with another man.

A message seeking comment was left for Mendonca's lawyer Sunday. There's no phone listing for Mendonca.

He is suing Providence police for alleged brutality. He was beaten unconscious in October 2009 after city officers stopped him on suspicion of theft and trespassing. Surveillance video showed a police officer using a flashlight to beat Mendonca, who was in handcuffs.

Detective Robert DeCarlo was convicted of assault in the beating, but the conviction was overturned because of prosecutorial misconduct.
